First let me tell you when the time comes for Nancy to be legally voted onto the board I will be voting for her. Why they have insisted on doing what they are by attempting to keep her on the board when they know it is against the law,but I am willing to forgive them for attempting it.
I do not know how long you have lived here but if you remember Catherine's board (on which Dan sat ) the ACT was not followed and was broken many times. This board esp. the three remaining sitting board members know whay went on Bob resigned from that board.
We wanted a safe, HONEST board at the previous AGM that is what we voted for.
What many people do not realize that if Nancy continues to sit on this board with out being voted there we the owners could suffer from this. Should anyone take this to court over their actions the court could appoint an administrator to look after our affairs and we would have very little to say about it, and a board could be appointed to sit and have very little to say of what goes on here until the courts think we can manage our own affairs.
They could look into our finances and say we do not have enough money in our reserve fund and either raise our maint. fees our call for a special assesment to top them up. This has happened in other places we do not need that here.
No one wants this. So in the face of this why would they insist in knowingly break the law and possibly cause this to happen? Did they hope no one would say anything?
We have seen many improvements since this board was installed in 2009. Why would we want to throw this away because they are breaking the law are they affraid of something ?
So my answer is not to remove Nancy from the board because she legally is not on the board but to follow the ACT as it should be and not take a step backward. If Nancy really wants to help this place, as a former board member she should run for the position again,and the new board must call for a vote and I am sure the people after listening to Seamus" rambling, shouting and interupting the meeting, not abiding by the rules, would not give anyone he would promote their vote. I have faith in the people of our community not to allow another group of people such as we had before in Catherine and her group try and dominate this place as they once did!
If you believe in following the Condo Act and not want it to be broken, have honest people looking after our affairs why would you want someone to illegally stay on the board?
If they insisted on illegally staying what would that tell you about them and yourself for that matter?
Have a vote and put her back on the board legally.

I'm sure that many of our residents have taken ESL, But there older ones that because of their age when they came here still have a problem with English . the Boards past and present have sent out information in English and Chinese to help bridge this gap. I personally see no problem in this it helps bridge a gap between us and keeps everyone informed, in communications from the Board it also states to check the English.
ReplyDeleteWe have a very diverse community here and now is not the time to try and divide it.
May be what the person is trying to say , if someone could translate the above comments and have it either posted here along with the English version or, print especially the above comments and have them sent to the owners in English and Chinese this would inform ALL people of the potential problem that the old board has created, and at the same time inform them all of this blog so we can all participate in our community and stop these things from happening again.
Most people I believe would agree to this but there may be some that would not agree.
Put this blog address in everyones mail box and tell your neighbours about this blog if you care. Then maybe things like this attempted deception will not happen again.

I agree both with the fact that everyone should be able to understand English but also I agree with the translation of the above text as this is very important stuff (if it is for REAL) that EVERYBODY should be aware of no matter if they UNDERSATND ENGLISH OR NOT. So we need to make sure all the non English proficient population, if any, in our condo is AWARE of the facts stated above. Then, they might find intresting if not really useful, to be able to understand the official language of this country and can go and take English lessons :-)
Just kidding - I know EVERYBODY in YCC 244 understands English well enough. But it's still worth the translation....

ReplyDeleteI guess there is at least one good thing about the mess, that is we won't have to pay their Lawyer bills if this goes further because they have knowingly broken the law and they will have to pay their own bills. They were told at the meeting and they have insisted on continuing with this.

I have a question about Michael's leaving the board.
ReplyDeleteDid he know what they were going to do and would not go along with them in keeping Nancy on the board ?....or ...Did they set him up to discredit him and if he complained people would not listen to him?..
If this was the case he sure didn't stay quite.
He told the truth in his letter to everyone...
Did you notice at the meeting that ALL questions were asked AFTER the vote, not before as has always been the case for years... I guess they didn't want any embarassing questions to be asked before the vote, that way the questions couldn't change peoples mind and the vote..
Smart move on their part wasn't it.
Love to have that vote again with people knowing what has been going on and how Bob,Nancy and Dan have put our Condos in a very bad place if someone takes this to court. We could be in deep trouble if this happens...Possibly a very different vote would have occuredhad people known how they are risking our Condos for ignoring the Law. ..... Why would they do this?? You can be sure they won't answer here!!!
Just giving it some thought...Maybe we all should!!!

Never mind Michael.How about Nancy! Just because she was second at the previous AGM in 2009 and was APPOINTED to the board knowing that she was to be there only until this AGM she STILL insists that she should be there and refuses to step down as the law states, she still refuses to do this and is ,along with the rest of the board (Bob/Dan) defying the law .
ReplyDeleteThey are putting this community at grave risk doing this and do not care to follow the law. This was clearly shown at the meeting where they also defied the law. How long will it take for them to realize this and call an immeadeate Election for this position. This should be done no later than Jan. 2011 so we the people have a full board to represent us. NOT a divided board with Dan and Bob possibly manipulating this situation for their own benifit what ever that may be.
NANCY MUST step down NOW and under the LAW cannot attend any Board meetings and if she is allowed to by Bob and Dan they again are openly defying the law and should removed.
People who are defending them are no better than they are! How about it,any of you three care to answer? BOB-NANCY-DAN why did you openly defying the law by not having Nancy's up for election?
What is your reason? There can be no justifcation for your actions!

If what you say is true why would they insist on doing this? We have a Lawyer he must have told them this! If they didn't ask they are in for real trouble. Let me clarify that ...We are in real trouble!
ReplyDeleteThe Lawyer read out the clause in the act at the meeting and most people received a letter at their door. They must have known about this!
ReplyDeleteAre we going back to the previous Boards way of doing things? Remember both Dan and Bob were on Catherines board. Is it contagious?
If all this is true and it seems to be why don't we get a Lawyer or DEMAND THAT OUR LAWYER PROSSICUTE THEM. He is afterall the condos Lawyer and that makes him our Lawyer!! He knows they have KNOWLINGLY violated the law and he would not be their Lawyer because they have broken the law and should be protecting our rights not theirs. We need a clarifcation on this, maybe from another Lawyer to see if our Lawyer should be doing something about this.

How can we do this anyone know. Why does the Lawyer not protect the owners rights we pay him to do this when he knows that the law. How do we get access to him?
Good luck on that they would block any attempt to do this.. Maybe some should call the Law Society and get help from them.

ReplyDeleteBefore you start to pay your hydro bill please check your Canet heater in your living or dining room to make sure it is working properly. If it is VERY HOT it could have a problem and needs to be fixed or replaced . If it is not working correctly and is over heating this could cost you a great deal of money on your hydro bill.
You SHOULD EMAIL THE OFFICE AND GO TO THE OFFICE AND FILL OUT A FORM AND GET A COPY OF THIS TO SHOW YOU HAVE REPORTED IT.
This will show that you have reported incase you have problems in the future.
Is Taft-forward involved in this mess ? It would be nice if some could find out if they might be involved or took part in it. They had to have known about it ...they sent out the notices!!!!!!! Why would they do this with out telling the board that they were wrong?..

This blog has been an interesting read. It was just emailed to me and I haveeen reading and find if all that has been published about the past board is true why has no one formed a committe and gone to OUR lawyer and have them charged? He is our Lawyer and was hired to protect us.We should be able to have these people charged for violateing the law! We should not have to go outside to lawyers to do this! He is hired with our money to protect our interests! With all that has gone on here has no one thought of this? The board that has broken the law should not be able to prevent us from doing this and neither should Management.

Does anyone have the results from the 2009AGM? We all know Nancy stayed on the board illeagly the question is .Is Bob on the board leagly ? He was last in the voteing and Nancy was behind him. Could he be on the illeagaly also? Someone should check this out ! We would be in a real fix if this was the case and so would he.
ReplyDeleteWho would you ask? Management? If you trusted them and believed that they would help you with this you could. But from being at the meeting I doubt that they would help you. You saw what they did....they held the question time AFTER the vote so we couldn't ask embarassing questions. That has NEVER been done before. Ask the Lawyer? You could try . He was there and didn't seem that he wanted to give a straight forward answer. He is the condo's lawyer the LEGAL board should ask him. Sounds strange dosn't it, that questions time was moved by Management and the old board ..a Lawyer that seemed to evade giving a straight answer and state that Nancy should NOT be on the board. Now is there a possibility that Bob should not be on the board? Will we EVER get a straight answer? with a split board Dan and Bob...Seamus and Mona. Will they get togeher and solve this? Not if the old board tries to prevent this... Who keeps the records? Management? The Lawyer? It's time to find out. The Board signs the checks they SHOULD AND MUST resolve this.

ReplyDeleteSources told me there was a board meeting last night and they were discussing the situation regarding Nancy. I heard they all elected here as an appointed member of the board. Any truth to this? I guess were all in deep trouble. Maybe we should call the government to get this worked out.
