I see by the notice that the board has had a meeting but have not said anything about Nancy's position on the board. NANCY is there illegally and a vote should have taken place at the AGM for her position. The board knows this and should call an election in January for her position at the latest. Now DAN NANCY AND BOB can stop any investigation into their involvement in this and any others that might have been involved. The Lawyer should have known that this was illegal he has been at least three of our AGEs or did they tell him. Does he not look after our legal affairs? Should he have not seen this and corrected it before it was sent out? Management sent out the notice they should have known! Or did only the board Management know that they were breaking the law and seemingly planned to do this and hope no one would notice? We are now in the position of having a board that may not be able to function properly because Dan, Bob and Nancy openly broken the law and can now stop any investigation into their actions because they can and do still control the board. Even if Nancy leaves there are only four members and DAN and Bob can prevent any investigation into their actions. This is unacceptable and they should be taken to court and made to pay all costs and be charged under the Condo Act. THEY will have to pay all legal costs and could be fined. Under the Law they have KNOWINGLY broken the law will have to pay for their own legal fees and the condo's!
Can you trust these three to continue to look after our affairs if they openly break the Law?
It is time to stop this and take this to a higher level!

Do you think Management was involved in this? JUSTIN should have known about this. He does keep records doesn't he? Something seems strange about this situation. A board that openly breaks the Law and a management company that dosen't seem to advise them of it!

ReplyDeleteSources told me there was a board meeting last night and they were discussing the situation regarding Nancy. I heard they all elected here as an appointed member of the board. Any truth to this? I guess were all in deep trouble. Maybe we should call the government to get this worked out.
ReplyDeleteYou won't get much help there. What we need is people in our community to get together and have Nancy,Bob and charged under the ACT and have them charged and removed form the board. This is the best way and would prevent them from being on the board and all the legal fees would have to be paid by them. They have openly broken the Law and don't seem to care. We must stop this NOW. If they are charged they will have to pay for the Corp. legal fees also.

What is the reason you are so much against Nancy (and lately, Bob). Did they do anything BAD or AGAINST us? Do yo KNOW if they did something BAD? If you DO please TELL US what it is. They seem nice people to me. But I might be wrong. If you know something SAY it.
ReplyDeleteYou must understand that Nancy was appointed to the board AFTER a previous member resigned. Under the Law that person ( Nancy) is only to be there until the next AGM which was just held. The board decided to ignore the law and when the AGM came only 3 positions were voted on there were to be 4 the Board,Management and our Lawyer were informed of this and yet the board chose to ignore the law.

Nancy's position ended at the AGM yet she is still there. She has no longer a legal board member, her APPOINTED position AND position legaly ended at the AGM and she cannot be appointed to sit at or hold any postion until an election is held. Her APPOINTED POSITION ENDED AT THE AGM.
By allowing her to stay after the AGM puts a this community and theirselves in a bad posttion. The court will have the say as to what happens to us and them because of their total disregard of the law.
Look up case histories where matters of condo's were taken to court and an administrator was appointed to oversee their condos. We will have very little to say in the running of our affairs, all because the previous board ( Bob, Dan and Nancy )CHOSE to IGNORE THE LAW this is why some people are angry at them. They seem not to care what the conseqences to us may be. JUST WHAT THEY WANT.
This is your home. Do you want someone in a position of trust openly ignoring and breaking the law and putting you and the rest of us in a position like this? I hope not,yet they seem not to care.
Even if they hold an election in the New Year For NANCY's position and she runs for it would you want someone who has shown total disregard for the law looking after your affairs! The Courts will decide if she can even run again.

If what you say is true Nancy must not be on the board now in any way. Her term expired at the AGM . Only the new board can appoint her to a position such as an Officer. She would have NO LEGAL standing to vote on anything. If the old board appointed her to a position her term still expired at the AGM. She cannot sign any checks after the AGM She has no legal position to do so. The new board , if a quroum is present could appoint anyone as an officer of the board. they would attend meetings but have no vote on any thing brought before the board. Only legally appointed BOARD members can vote.

Has something else gone wrong? Do they not want someone new looking into their actions as board members? It seems strange that they did not want to follow the Law and have an proper vote and when they KNEW that what they were doing was ILLegal. Only they know why... As you said it will come out in court.
They must have a lot of money to spend if they chose this route. It will take them away from their work. Some I believe are self employed and this could lose them business, it will cost everyone involved in this matter money.
Why would they risk this? Is it because there is something they don't want us to know?
We had problems before the 2009 AGM and I thought we left them behind. It seems we didn't. Bob and Dan were both on that board with Catherine as president. Is this the same problem occuring again with these members?
Matbe they were the problem and not Catherine...Possible?

What I'm not grateful for is when they dont want to leave and try to stay to cause problems for newly elected members. Nancy position was over in the AGM, its clear, its in the condo act. She wants to be on the board, great but others want to be there too, she needs to run and get elected for that seat like everyone else!

We must continue with Taft (no any company will make a difference but the people), we should pay to a property manager only by results and the owners sutisfuction with the Taft's management, we must complete with the submetering with a valid and correct contract agreement with the hydro supplier company, the Board must rule the game but not the management company and under a close supervision and reviewing all the Board activity by the owners. There is talk going around our place that a current Board Member owns or has a financial interest in a Management Co.. This is totally untrue and the person(s) that are spreading this is lying and should be careful of what they say. There are laws in this country regarding this.This is the type of person that divides a community by spreading false accusations against people and they should be ignored. These type of people look after only their OWN interests. This is a community that we ALL own and have an interest in Financially and as a functioning place to live with each other.
